An auto Insurance falsely salvaged my car what can I do ?

My car was in an accident it was the other person's fault so I went through there insurance because I didn't want to pay the deductible. There insurance decided my car was beyond repair and totaled it but couldn't cover the full amount my car was worth because they said they capped out. So I'm having it "FIXED" with my insurance company instead because they're willing to pay for the repair instead of totaling it, but the first insurance company already officially totaled to DMV. I don't want my car to be a salvage title it'd cost too much to sell correct ? what can I do ?An auto Insurance falsely salvaged my car what can I do ?
In most states, the car only becomes a total to dmv if - you sign the title over to the insurance company and the insurance company sends that title into the dmv and applies for a salvage title.



If the other insurance company deemed the car a total loss. That's not false. It's their opinion that the repairs will equal or exceed 75% of the cars value. In some states, a car is a total loss when a major component of the car is damaged. It is the other companies professional opinion that the car was a total. However, your car's value exceeded their coverage limit.



So it sounds like your insurance company wrote their own estimate and came up with a different amount.



I'd start by contacting dmv and finding out if something was sent to them.



If it was, find out what needs to be done for the car to be allowed on the road way. The dmv may need to inspect it.



From what you've posted, the other insurance company did not do anything inappropriate.

The engineers (or appraisers as the North Americans call it) of both insurance companies will need to be involved as one has stated the vehicle is beyond economical repair, whilst your insurer's engineer has deemed it repairable. It will need to be inspected again (or both appraiser reports will need to be reviewed if it's already been repaired) by an independent appraiser. Then which ever they decide that will most likely be the final decision.
If your car is a total loss, it's a total loss - regardless of how much the insurance pays. They are REQUIRED by LAW to report it as a total loss to your state DMV.



So they did NOT falsely salvage your car.



You need to talk to your adjuster. You can't be paid for the same thing, from two different insurance companies. YOu need to turn the entire check you got from the other guy's insurance, over to your insurance. The insurance company did not falsely total your vehicle. This is a STATE LAW -- when the cost of repairs exceed the value or a set percentage of the value then they are obligated by law to declare the vehicle a total loss. YOU decided to let them handle the claim so this is exactly what they did. The fact that the other driver didn't have enough insurance isn't their problem. Your problem is with the DMV now so you better get ready for a world of hurt.
